Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs every buyer, licensee, and authorized user of Operator business lists and data products ("the Data"), including any contact, firmographic, or business-registration records obtained from operator.fyi. It is incorporated by reference into the Terms of Service. By accessing or using the Data you agree to this AUP; violating it is a material breach of the Terms.

The Data is licensed solely for legitimate business-to-business outreach and research. You may use it to identify, research, and contact businesses in their commercial capacity for lawful B2B purposes.

You may not use the Data:

• For consumer or business-to-consumer (B2C) marketing of any kind.
• To contact any individual in their personal or household capacity, or at a personal phone number, email, or address.
• To market products or services to consumers rather than to businesses.

You are the sender, caller, or party of record for any outreach you conduct using the Data, and you are solely responsible for the compliance of that outreach. You must:

• Immediately honor every opt-out, unsubscribe, and do-not-contact request you receive, across every channel.
• Maintain and apply your own suppression lists so that anyone who has opted out is not contacted again.
• Comply with all applicable laws, including CAN-SPAM, the TCPA, and applicable state telemarketing and privacy laws (including the CCPA/CPRA and comparable state statutes).
• Obtain any consent required by law, observe local quiet-hours restrictions, identify yourself accurately, and provide a working opt-out mechanism in every message or call.

Operator does not send outreach on your behalf and is not the sender or caller of record for your campaigns. Responsibility for outreach compliance rests entirely with you.

The Data is licensed to you for your own internal business use only. You may not:

• Resell, sublicense, rent, lease, or otherwise commercialize the Data.
• Redistribute, publish, share, or transfer the Data to any third party.
• Create or distribute any derivative list, database, or product built from the Data.

Any distribution beyond your own organization requires a separate written agreement with Operator.

You may not use the Data to:

• Reverse-append, enrich, or match business records to consumer or personal records.
• Link the Data to individuals' personal identities, home addresses, personal devices, or household information.
• Build, augment, or sell consumer profiles or consumer marketing audiences of any kind.

You may not use the Data or the operator.fyi site and API to:

• Engage in any unlawful, deceptive, fraudulent, harassing, or discriminatory activity.
• Violate any applicable law, regulation, or order, or infringe or misappropriate any third party's rights, including intellectual-property and privacy rights.
• Impersonate any business or person, or misrepresent your identity or affiliation.
• Scrape, harvest, crawl, or otherwise access the site or API beyond posted rate limits, or use automated mechanisms to circumvent authentication, quotas, or anti-abuse controls.

The Data is compiled from public business registrations, public filings, and publicly available business web presence. It is provided "as is," for business intelligence and research purposes, without any warranty of accuracy, completeness, or fitness for a particular purpose. Records may be incomplete, outdated, or contain errors. You are responsible for independently verifying any record before relying on it or acting on it.

Any violation of this AUP is a material breach of the Terms. Operator may, at its discretion and in proportion to the violation, warn you, throttle or suspend your access, terminate your license, and pursue any remedies available at law or in equity, including injunctive relief.

We may update this AUP from time to time as laws and use patterns evolve. The revised policy takes effect when posted, and your continued access to or use of the Data constitutes acceptance of the updated terms.
