1. Acceptance of terms

Plain language: By using operator.fyi you agree to these Terms. If you do not agree, do not use the service.

These Terms of Service ("Terms") govern your access to and use of operator.fyi and all related services ("Service") provided by Operator AI LLC ("Operator", "we", "us"). By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy.

2. Service description

Plain language: Operator is a market intelligence and business management tool. The Market Analyst agent is free. Autopilot hires the full team at $499/mo.

Operator provides a market intelligence directory, a Business Health Score, and a set of AI agents that assist small local businesses. Two tiers are available: Free (Market Analyst agent) and Autopilot ($499 per month). We may change features with reasonable notice. Operator is a software tool. It is not a licensed accountant, attorney, marketer, or medical provider. It does not replace professional advice. Autopilot is not a call center, not an ad buyer, and not a legal service.

3. Accounts and business claim authority

Plain language: You need an account for paid features. When you claim a business you confirm you own or operate it.

To access certain features you must create an account. You agree to provide accurate information, maintain the security of your credentials, and notify us of any unauthorized access. When you claim a business listing you represent that you are the owner or a duly authorized representative of that business. Fraudulent claims are grounds for immediate account termination.

4. Acceptable use

Plain language: Do not use Operator to spam, scrape, hack, or break the law.

You agree not to use the Service to:

  • Violate any law or regulation.
  • Infringe on the rights of any person or business.
  • Send unsolicited commercial messages in violation of TCPA or CAN-SPAM.
  • File false claims on business listings you do not own or operate.
  • Interfere with or disrupt the Service or its underlying infrastructure.
  • Reverse engineer, scrape at scale outside the published API, or circumvent rate limits.
  • Abuse, harass, or threaten other users or Operator staff.

5. Subscriptions and billing

Plain language: Autopilot is $499/mo or $415/mo billed annually. 14-day free trial. One-tap cancel. Your price is locked at the rate you signed up at.

Autopilot subscriptions bill in advance on a monthly or annual cadence. The annual plan is discounted to $415/mo (billed yearly at $4,980). A 14-day free trial applies to new subscribers. You may cancel at any time from your account settings or the Stripe customer portal. Upon cancellation the Service continues at the paid tier through the end of the current billing period and then downgrades to the Free tier. Your subscription price is locked at the rate you signed up at for as long as the subscription remains continuously active.

6. Refund policy

Plain language: The 14-day trial is how you try Operator. After trial, subscriptions are non-refundable for partial periods except where required by law.

The 14-day free trial is the refund mechanism. You may cancel at any time during the trial and you will not be charged. After the trial ends and a subscription begins, we do not issue prorated refunds for partial billing periods except where required by law. We will refund charges made in clear error (duplicate charge, billing mistake) upon good-faith request.

7. Intellectual property

Plain language: We own our software and brand. You own your business data. AI-generated output tied to your account is yours to use.

Operator retains all rights to the Service, including software, trademarks, and trade secrets. You retain all rights to content you provide or generate through the Service about your own business. You grant us a limited, worldwide, royalty-free license to use your content solely to provide and improve the Service for you. Output generated by Operator agents on your behalf (suggested review replies, draft posts, briefings, etc.) is licensed to you for your business use.

8. Data use

Plain language: Your data is yours. We never sell it. See the Privacy Policy for details.

How we collect, use, and share your data is described in the Privacy Policy, which is incorporated into these Terms by reference. We never sell personal data. We never train third-party foundation models on your private conversations.

9. Warranties and disclaimers

Plain language: We work hard to make Operator reliable, but we cannot promise perfection.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific outcome will result from use. We do not warrant the accuracy of third-party data surfaced in the directory.

10. Limitation of liability

Plain language: If something goes wrong, our liability is capped at what you paid us in the last 12 months.

To the maximum extent permitted by law, Operator's total liability for any claim arising from or related to these Terms or the Service is capped at the amount you paid us in the twelve months preceding the claim. In no event are we liable for indirect, incidental, consequential, special, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless Operator, its officers, directors, and employees from any claim, liability, or expense arising from your violation of these Terms, your use of the Service, or your content.

12. Dispute resolution and governing law

Plain language: Disputes are resolved under Hawaii law. Binding arbitration in Honolulu.

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved through binding arbitration in Honolulu, Hawaii, except where prohibited by law and except that either party may seek injunctive relief in court for intellectual property or confidentiality disputes.

13. Changes to terms

Plain language: We can update these Terms. Material changes are announced by email at least 30 days in advance.

We may update these Terms from time to time. Material changes will be announced via email to registered users at least 30 days in advance and reflected with an updated last-updated date at the top of this page. Continued use of the Service after the effective date constitutes acceptance.
